Overview of Potato Plant Variety Protection: Requirements and Examination Process.

AN application for Plant Variety Protection (PVP) includes several parts (Exhibits), including the breeding history, statement of distinctness, objective description of the variety, any additional description information, basis of ownership, a voucher for tissue culture deposit, and the application fee. A variety needs to be new, distinct, uniform, and stable for protection to be granted. Criteria used for selection, development, and evidence of uniformity and stability should be provided with the breeding history. Comparisons with similar varieties should clearly establish how the new variety differs, with supporting evidence, such as shape descriptions and photographs, color descriptions and charts, quantitative differences, and disease ratings. Descriptors of the new variety are used to establish distinctness. Ownership establishment should report any company that retains rights to the variety. Tissue cultures must be submitted to the National Center for Genetic Resources Preservation or another acceptable public repository. After receiving a complete application, a unique number is assigned to the variety – giving it temporary protection, and the applicant is notified. The actual examination begins after an objective review of the application’s exhibits, if necessary, additional information or clarifying responses are requested. All information submitted with the application is entered into the potato database which contains information on all previously issued protected and public varieties released worldwide. Then a search is conducted to establish the uniqueness of the variety. Applications for unique varieties are recommended to the Commissioner for Plant Variety Protection. After approval, the applicant is required to provide tissue culture samples and the certificate fee. The certificate is issued, signed by the Secretary of Agriculture, and mailed to the applicant.
